LAND SALE COMPLETED BY CEDAR MOUNTAIN

 Cedar Mountain Environmental announced today that it has completed the sale of 315 acres of land in Tooele County to Envirocare of Utah.  This section of land was given final siting approval from the State of Utah for the disposal of radioactive waste last year and is located adjacent to the current Envirocare facility.  Envirocare’s purchase of this land supports the idea that there is a need for additional radioactive waste cell space.

 

Cedar Mountain appreciates the efforts of the new management of Envirocare in their purchase of this property and looks forward to an amicable relationship between the two companies in the future.

 

Because of the need for additional facilities, Cedar Mountain is still pursuing site(s) for the disposal of radioactive waste.  Cedar Mountain is currently in the process of securing other sites which it can purchase with the hope of establishing disposal operations.  Cedar Mountain is looking at sites both inside and outside of the State of Utah.

 

Cedar Mountain has yet to determine the exact types of waste that it will be accepting at either facility.  Cedar Mountain President Charles Judd commented, “There are many different types of waste under consideration at this time.  The marketplace and the political atmosphere are changing drastically and we are in a wait and see mode for the next few months until some of these things settle down.  When that happens we will be making some important decisions about the direction of our company.”     

 

Cedar Mountain’s forecast is for a significant increase in business in 2005.  The transportation division is continuing to grow at a healthy rate and is in the final stages of securing several significant contracts.  Cedar Mountain is also anticipating adding to their fleet of 450 radioactive waste transport containers that are currently in service at this time.  Appropriate adjustments will be made in the waste disposal operations and significant progress is expected in that area the remainder of the year.

FINAL SITING APPROVAL GIVEN FOR CEDAR MOUNTAIN

On October 8, 2004 Cedar Mountain Environmental (CME) received notification that the CME siting application is complete and the siting requirements and criteria have been met for the Clive facility.  This is a huge step forward for our operations in western Utah. 

Cedar Mountain has been working with the Division of Radiation Control on the siting criteria for over a year and appreciates the time and effort of all organizations and individuals involved.  The siting criteria is one of the first steps in licensing the facility for waste disposal.  Cedar Mountain is currently preparing a license application for waste disposal that will be submitted to the Division of Radiation Control in the near future. 

Cedar Mountain has not made a final decision on the types of waste that will be accepted at the proposed facility, however, CME understands that as the other facilities that accept waste continue to fill up, there will become a greater need for waste disposal options in the United States.  CME is preparing to be ready to step in and provide needed cell space for different types of waste as the needs arise.  CME also understands that further work will need to be done with the State of Utah and Tooele County before any wastes can be accepted at the facility and intends to aggressively pursue the required steps for proper approval. 

In the past several months CME has also acquired a radioactive waste transportation company and is looking forward to using the Clive site for a transfer facility for wastes that are being shipped to a variety of facilities in the Western United States.  CME is continuing to investigate other uses for the Clive site.

Press Release

On March 17, 2004, CME recieved the decision of the Tooele County Commission regarding its appeal of the Planning Commission's denial of Cedar Mountain's application for a temporary conditional use permit.  Regrettably, the County Commission denied CME's appeal and affirmed the Planning Commission's decision to not grant a temporary conditional use permit, stating that CME had not shown a need for another disposal facility in Tooele County. 

Although CME is disappointed that the County Commission did not overturn the Planning Commission's decision, CME will continue forward with its contention that there is a need for another disposal facility in Tooele County.  Consequently, CME will appeal its decision to the state district court within the next 30 days. 

A significant part of CME's appeal will be to challenge Tooele County's interpretation of its rules and regulations concerning the demonstration of need and its procedure for review and approval of an application for a Temporary Condition Use Permit for a radioactive waste disposal facility.  Even though the County regulations do not appear to require an applicant to demonstrate need until it applies for a permanent conditional use permit, CME provided evidence of a proven market and a market need for a competing disposal facility as part of the application.  Cedar Mountain will appeal to the state district court to determine whether CME has satisfied the requirements for obtaining a temporary  conditional use permit, including whether it has demonstrated a market need.

PRESS RELEASE

On Thursday, October 2, 2003, CME appealed to the Tooele County Planning Commission's denial of its request for a Temporary Conditional Use Permit (the initial step toward receiving approval to operate a disposal facility in Tooele).  The appeal was submitted to the Tooele County Commision for their review and decision.  Cedar Mountain feels that the basis for its appeal is sound and is confident that the County Commission will properly follow its ordinances and grant that the permitting process move forward.  Please feel free to contact Charles Judd at 801-942-3757.
